SOUTH BERWICK PLANNING BOARD
REGULAR MEETING MINUTES
May 19, 2009
7:00 PM

ROLL CALL

Present: Chair Cheryl Dionne, Brad Christo (Vice Chairman), John Stirling, Mimi Demers, Bill Straub and Jim Fisk (Planner).

Not Present: Richard Clough and Bruce Whitney

Susie Scott, Assistant to the Town Planner, was taking minutes.

Bill Straub will be a voting member tonight.

CALL TO ORDER

Chairman Dionne called the regular Planning Board meeting to order at 7:05 PM.

MINUTES APPROVAL

May 5, 2009 - Regular Meeting: Motion by Mrs. Demers, second by Mr. Stirling to approve minutes as written, passed unanimously.

In discussing the 5/5/09 minutes, the Board requested Mr. Fisk to write a memo summarizing his contact with affected owners in the new proposed Shoreland Zone. Mr. Christo recommended Mr. Fisk capitalize "Shorezone" on the proposed Shoreland Zoning Map.

OLD BUSINESS and ORDINANCE UPDATES
1. Shoreland Zoning: Further Review.

" Proposed Shoreland Zoning Ordinance - Chapter 110. Prepared with memo cover sheet from Jim Fisk to John B. Schempf, Town Manager entitled "Shoreland Ordinance, proposed". ("v7" as revised per 5-12-09 PB Workshop).
" Map: May 15, 2009 draft. "Existing Shoreland Zoning and New shorezone, Inland Wading Waterfowl Habitat (IWWH) Areas".

The Planning Board reviewed the proposed ordinance "v7", and made minor edits as noted on draft copy. See hand written notes in agenda file.
The Board recommended the following edits:

Ordinance
" Change language for Fife's Lane to include Old South Road. The Board questioned including everything on Fife's Lane and Old South Road, and Mr. Fisk will double check the western portion of this area for its development pattern.

Map
" Limited Residential Shoreland District is added to the map to adequately illustrate the new district.
" Correct spelling for Leigh's Mill Pond.
" Consolidate and revise Legend.

Other
" Per Chairman Dionne request, Mr. Fisk to provide a list of properties that are affected. Mr. Fisk stated this list could be posted online.

Mr. Fisk clarified that buildings need to be within 500 feet of one another to be considered a Limited Residential Shoreland District.

Chairman Dionne discussed the Board conducting a Joint Public Hearing with the Town Council to discuss the new Shoreland Zoning Ordinance as well as the changes to Chapter 140 specific to Shoreland Zoning. The notification process for the upcoming Joint Public Hearing will be discussed at June 2nd meeting.

Mr. Straub commented that after reviewing the new information provided, the review process is simpler than previously thought.

OTHER

1. Mr. Fisk discussed the application for the Our Lady of the Angels Parish (Map 12 Lot 2 - Agamenticus Road) has submitted a complete application and requested to be on the June 2, 2009 Planning Board agenda. CMP has also requested to be on the June 2, 2009 agenda. Mr. Fisk stated that Chris Vaniotis, Town Attorney stated that since the transmission poles are not considered structures and therefore cannot be considered non-conforming, CMP is allowed to do existing work without going to Board.

Motion by Mr. Stirling, second by Mr. Straub to adjourn the meeting. The meeting was adjourned without objection at 8:18 PM.
