Zoning Ordinance – Mobile Vending
December 9, 2014

Chairman John C. Kareckas opened the hearing at 6:30pm.  Councilors present included Jean Demetracopoulos, Russell H. Abell, and John James.  Town Manager Perry A. Ellsworth was also in attendance.  Laura Leber was not present.

The purpose of the hearing was to receive public comment on the proposed amendments to sections 140-9 Definitions, 140-58 Restaurants, and 140-58A Outdoor Sales of the Zoning Ordinance.

Bill Straub, Planning Board Vice-chair, explained that the proposed changes to the ordinance will clarify what must be approved by the Planning Board and what needs a permit from the Code Enforcement Officer.  When discussing the changes, the Board focused primarily on restaurants, take out restaurants and merchandising of non-food items and their definitions.  The most significant change would require restaurants to be in an enclosed building that is permanently attached to the land.  Mr. Straub went on to explain that there are exemptions, such as special events or festivals authorized by the Town Council and the seasonal sale of produce and plants.

No one in the audience wished to speak.

The hearing was closed at 6:45pm.
